US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge stated in her order.
The case stems from a erroneous removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to answer human smuggling charges, he was held in federal custody.
In her decision, the court noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Background of the Case
The court challenge involve conflicting assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
He has also pleaded not guilty to the smuggling charges, which are part of a ongoing criminal case in Tennessee.
Conditions of Freedom
The court, who was overseeing his petition to removal in a Maryland district court, determined that he must now comply with the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
This ruling marks a notable turn in a complicated legal case involving claims of mistaken imprisonment and contested criminal affiliations.
